These Website Terms of Use ("Terms") govern access to and use of kindafar.com and other websites or online pages operated by Kinda Far LLC (collectively, the "Site"). By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
These Terms govern website use only. A trip inquiry, creator application, form submission, invoice, or payment does not by itself create an accepted travel booking or replace a signed agreement.
1. About Kinda Far and Eligibility
The Site is operated by Kinda Far LLC ("Kinda Far," "we," "us," or "our"), a Texas limited liability company based in Austin, Texas. The Site is intended for adults. You must be at least eighteen (18) years old and legally capable of agreeing to these Terms to submit a trip registration or creator application.
We may limit the availability of content, applications, trips, or services based on residence, destination, eligibility, capacity, legal requirements, or other legitimate business considerations.
2. Travel Information, Applications, and Bookings
Website descriptions, sample itineraries, prices, availability, photographs, maps, destination information, and program details are general information and may change. They are not a booking confirmation, warranty, or promise that a particular service, supplier, activity, room, schedule, or benefit will be available.
A travel booking is governed by the applicable Traveler Agreement and Trip Terms & Booking Addendum, together with any creator or campaign agreement that applies. A booking is accepted only in the manner stated in those agreements. If these Terms conflict with a signed booking agreement, the signed booking agreement controls for the booked trip and subject addressed.
Kinda Far does not sell, arrange, or assume responsibility for airfare. Any future charter or Company-arranged flight requires a separate written agreement. Additional travel disclosures appear at kindafar.com/travel-disclosures.
3. Creator Applications and Submitted Information
Submitting an inquiry or creator application does not guarantee selection, acceptance, a hosted benefit, a booking, or future work. We may evaluate applications and public creator profiles for legitimate program purposes, subject to our Privacy Policy and applicable law.
You represent that information you submit is accurate, current, and yours to provide. You retain ownership of application materials and other content you submit. You grant Kinda Far a limited, nonexclusive license to receive, store, reproduce, and review submitted content only as reasonably necessary to evaluate the submission, respond to you, operate the Site, prevent misuse, and comply with law. Public promotion, commercial likeness use, creator deliverables, and broader content rights require the applicable signed agreement or separate permission.
4. Permitted Use and Prohibited Conduct
You may use the Site for personal, lawful, noncommercial purposes related to learning about Kinda Far, making an inquiry, applying for a program, or managing a permitted interaction with us. You may not:
- Use the Site unlawfully, fraudulently, deceptively, or to violate another person's rights.
- Interfere with Site operation, security, access controls, forms, servers, or networks.
- Introduce malware, harmful code, automated traffic, scraping, harvesting, or excessive requests without written permission.
- Attempt to gain unauthorized access to accounts, systems, data, or nonpublic portions of the Site.
- Copy, frame, mirror, republish, sell, sublicense, or commercially exploit Site content except as expressly permitted in writing.
- Impersonate another person, misrepresent an affiliation, or submit false or misleading information.
We may restrict or terminate access, reject a submission, preserve evidence, or take other reasonable action when we believe use of the Site violates these Terms, threatens security, or exposes Kinda Far or another person to material risk.
5. Intellectual Property
The Site and its original text, design, graphics, photographs, video, branding, logos, selection, arrangement, and software are owned by or licensed to Kinda Far and are protected by intellectual-property laws. No ownership right is transferred to you.
If you believe material on the Site infringes your copyright or other rights, send a detailed notice to [email protected] identifying the work, the challenged material and location, your contact information, and the basis for your claim.
6. Third-Party Sites and Services
The Site may link to or integrate with travel suppliers, payment processors, electronic-signature services, social platforms, maps, analytics providers, insurers, or other third parties. Links and integrations are provided for convenience and do not make the third party our employee, partner, or agent. Third-party services are governed by their own terms, privacy notices, availability, and security practices.
7. Website Disclaimers
Destination, entry, health, safety, weather, supplier, and travel information can change quickly. Site content is not legal, medical, financial, insurance, immigration, or security advice. You are responsible for verifying current requirements with appropriate governmental authorities, suppliers, airlines, and qualified professionals.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, KINDA FAR AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE SITE, INCLUDING LOST DATA, LOST PROFITS, LOST OPPORTUNITY, OR REPUTATIONAL HARM.
TO THE FULLEST EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID KINDA FAR, IF ANY, SPECIFICALLY FOR ACCESS TO THE SITE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not govern liability under a signed travel agreement and do not limit rights or remedies that cannot lawfully be limited.
9. Indemnification
To the fullest extent permitted by law, you will defend, indemnify, and hold harmless Kinda Far and its members, managers, employees, contractors, and representatives from third-party claims, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful misuse of the Site, material violation of these Terms, infringement or misuse of another person's rights, or content or information you submit without authority. You are not required to indemnify a protected party for that party's own gross negligence, willful misconduct, or fraud.
10. Electronic Communications and Privacy
You agree that we may communicate electronically about Site use, inquiries, applications, and transactions you initiate. You are responsible for providing accurate contact information and monitoring messages. Marketing communications are governed by applicable consent and unsubscribe requirements; a contact inquiry does not automatically enroll you in marketing.

11. Changes, Suspension, and Termination
We may update the Site and these Terms as our services, practices, or legal obligations change. The current Terms will be posted at kindafar.com/terms with an effective date. Changes apply prospectively when posted unless additional notice or consent is required by law.
12. Governing Law and Disputes
These Terms and disputes arising from Site use are governed by Texas law, without regard to conflict-of-law principles. Subject to mandatory law, you consent to exclusive jurisdiction and venue in the state courts in Travis County, Texas, or the federal court serving Travis County.
Before filing suit, the complaining party must send written notice describing the dispute and requested resolution. The parties will attempt in good faith to resolve the matter informally for at least thirty (30) days.
13. General Terms
These Terms, together with the Privacy Policy and any notices expressly incorporated here, are the entire agreement concerning use of the Site. Signed travel, creator, campaign, or other service agreements separately govern their stated subjects. If a provision is invalid or unenforceable, the remaining provisions continue in effect and the invalid provision will be modified only as necessary to preserve its lawful purpose.
